Curabit Healthpods Terms of Use: Version 2.0

By accessing or using Curabit Healthpods (“Healthpods”), you (“Licensee”) enter into a legally binding agreement with Curabit. This Agreement outlines your responsibilities and is subject to all applicable laws and regulations. Curabit reserves the right to update or revise these Terms at any time without prior notice. Your continued usage of the Healthpods constitutes acceptance of any such changes.

2. Scope of Use License

Curabit hereby grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Healthpods for personal, non-commercial healthcare and wellness activities, as outlined herein.

2.1 Permitted Use

The Healthpods are designed to serve as multifunctional patient care units for healthcare and wellness services. Their usage encompasses activities like medical assessments, remote physician consultations, and the provision of healthcare information.

2.2 Compliance with Intended Use

You agree to utilize the Healthpods strictly in accordance with their intended functionalities, as specified in Section 2.1. Any deviation from this intended use may result in license termination.

3. Prohibited Actions

3.1 Unauthorized Activities

You shall not engage in activities that compromise the Healthpods’ intended use, functionality, or security features. Such activities include, but are not limited to, tampering, unauthorized access, or illicit usage.

3.2 Unauthorized Modifications

Modifying the Healthpods in a manner inconsistent with their intended use or without Curabit’s prior written approval is strictly prohibited.

4. User Conduct and Access

Users must be of legal age as per their jurisdiction to access the Healthpods. You are responsible for ensuring that your conduct and any data submitted does not violate any law or third-party rights. Non-compliance may result in the suspension or termination of your access.

5. Data Privacy

Your interaction with the Healthpods is governed by our Privacy Policy, to which you must agree before using the Healthpods.

6. Disclaimers

6.1 No Substitute for Professional Advice

The Healthpods offer health-related information for informational purposes only, and they are not a substitute for professional medical advice or treatment.

6.2 Data Accuracy

7. Limitation of Liability

Curabit shall not be liable for any damages, direct or indirect, resulting from your use or inability to use the Healthpods.

8. Legal Governance

This Agreement is governed by the laws of the State of Oregon. All disputes shall be resolved through binding arbitration within the State of Oregon.

9. Amendments to Terms

Curabit reserves the right to modify these Terms. Changes will be communicated via email or through the Healthpods interface.

10. Location-Based License

10.1 Designated Usage

You are authorized to use the Healthpods only at the locations designated by Curabit.

10.2 Relocation Restrictions

Relocating the Healthpods without explicit authorization from Curabit is strictly forbidden.

11. Maintenance and Appearance

11.1 Hygiene

You agree to abide by Curabit’s guidelines for maintaining the hygiene standards of the Healthpods.

11.2 Physical Condition

You agree to keep the Healthpods in optimal condition and report any damage or malfunction to Curabit immediately.
